IMPORTANT — READ BEFORE USING THIS SERVICE
PostWatch is an entirely voluntary service. No person is required to use PostWatch for any reason. If you are uncomfortable with facial recognition technology, community safety alerts, user-generated content, biometric data processing, or any other aspect of this Service, you should NOT create an account and should NOT use the Service. If you have already created an account and wish to stop, you may delete your account at any time through your Account Settings page.
By creating an account, uploading content, or otherwise using this Service, you voluntarily and affirmatively consent to all terms, conditions, disclaimers, and limitations described herein. Your continued use of the Service constitutes ongoing acceptance of these Terms. HOAPOST, LLC shall not be liable for any consequence — emotional, psychological, physical, financial, or otherwise — arising from your voluntary decision to use this platform.
If this Service ever causes you stress, anxiety, discomfort, or distress of any kind, you are strongly encouraged to immediately cease all use and delete your account. The sole and complete remedy for dissatisfaction with the Service is to stop using it.
1. Acceptance of Terms
By accessing, browsing, registering for, or using HOA PostWatch ("PostWatch", "the Service"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions ("Terms"), which constitute a binding contract between you ("User", "you") and HOAPOST, LLC ("Company", "we", "us"). If you do not agree to every provision of these Terms, you must immediately cease all use of the Service and delete your account if one exists.
These Terms incorporate by reference the Privacy Policy, Biometric Data Notice, and all disclaimers presented during account registration, content upload, and Service use. Together, these documents constitute the entire agreement between you and HOAPOST, LLC regarding your use of the Service.
2. Service Description & Ownership
PostWatch is a community safety awareness platform that uses automated facial recognition technology and optical character recognition to analyze photos uploaded by HOA community members. The Service detects faces in uploaded images, generates biometric embeddings, cross-references them against existing records within your HOA community, and provides vehicle awareness reporting through automated license plate recognition.
PostWatch is a service provided by and wholly owned by HOAPOST, LLC. PostWatch is not a separate legal entity. All rights, obligations, and liabilities described in these Terms are those of HOAPOST, LLC. Any reference to "PostWatch" or "HOA PostWatch" in these Terms or elsewhere on the platform refers to a service of HOAPOST, LLC and not to an independent entity.
HOAPOST, LLC is a passive intermediary platform provider. HOAPOST, LLC does not create, curate, endorse, verify, or take responsibility for any user-submitted content. All content displayed on the Service is created by and is the sole responsibility of the users who upload it.
3. Eligibility
You must be at least 18 years old and a member of a participating HOA community. The Service is not available to residents of Illinois, Texas, or Washington state due to biometric privacy legislation (BIPA, 740 ILCS 14; CUBI, Tex. Bus. & Com. Code § 503.001; Washington HB 1493).
By creating an account, you represent and warrant that you are at least 18 years of age, that you are a lawful resident or property owner/renter within a participating HOA community, and that you have the legal capacity to enter into this binding agreement.
4. User Responsibilities & Prohibited Conduct
You acknowledge and agree to the following:
4.1 Content Submissions
- You will only upload photos that you personally captured using your own device.
- You will only upload photos captured in public places where no reasonable expectation of privacy exists under applicable law, including but not limited to public streets, sidewalks, parking lots, common areas, and other locations plainly visible from public vantage points.
- You represent and warrant that each photo you upload was captured from your own normal, safe vantage point without approaching, following, or altering your position to obtain the photo.
- You represent and warrant that you have the legal right to upload and assign all content you submit.
- You are limited to 2 photo uploads per day.
4.2 Prohibited Uses
You shall NOT use the Service to:
- Harass, stalk, threaten, intimidate, or bully any individual or group.
- Doxx any person — i.e., publish, share, or distribute any individual's personal information (name, address, workplace, school, phone number, or any other identifying information) obtained through or in connection with the Service.
- Discriminate against any individual on the basis of race, color, religion, sex, sexual orientation, gender identity, national origin, ethnicity, age, disability, familial status, or any other protected characteristic under federal, state, or local law.
- Racially profile or target any individual or group based on race, ethnicity, skin color, national origin, or perceived immigration status. PostWatch operates in HOA communities subject to the Fair Housing Act (42 U.S.C. § 3601 et seq.), and any use of the Service that facilitates housing discrimination is strictly prohibited and may be reported to the U.S. Department of Housing and Urban Development.
- Weaponize the platform — i.e., use the Service as a tool for retaliation, vendettas, neighborhood disputes, or personal grievances unrelated to legitimate community safety.
- Impersonate any person, organization, or entity, or falsely represent your affiliation with any person, organization, or entity.
- Upload offensive, explicit, sexually suggestive, violent, hateful, or otherwise inappropriate material.
- Attempt to identify, name, accuse, or take adverse action against any individual based on facial recognition results, vehicle reports, or any other data obtained through the Service.
- Share, distribute, screenshot, photograph, record, or transmit any content, results, matches, or data from the Service to any third party or external platform by any means.
- Use results for employment, housing, credit, insurance, or educational decisions subject to the Fair Credit Reporting Act (15 U.S.C. § 1681).
- Submit any content or result as evidence in any legal, administrative, or investigative proceeding.
- Combine data from the Service with external data sources to attempt to identify or locate any individual.
- Attempt to reverse-engineer, manipulate, deceive, or circumvent the facial recognition system, content moderation, or any security measure.
- Create multiple accounts or use the Service from a blocked jurisdiction.
Violation of any prohibited use may result in immediate account suspension or permanent termination, at HOAPOST, LLC's sole discretion and without prior notice.
4.3 Anti-Discrimination & Fair Housing Compliance
HOAPOST, LLC is committed to compliance with the Fair Housing Act (42 U.S.C. § 3601 et seq.) and all applicable federal, state, and local anti-discrimination laws. PostWatch must not be used to profile, target, surveil, or discriminate against any person based on race, color, religion, sex, national origin, familial status, disability, sexual orientation, gender identity, or any other protected class. Users who engage in discriminatory conduct through the platform will have their accounts immediately terminated and may be reported to appropriate civil rights enforcement authorities.
The facial recognition and vehicle recognition technologies used by PostWatch are automated systems that operate on mathematical similarity and optical character recognition. These technologies do not consider, factor, or account for any demographic characteristic in their processing. Any biased or discriminatory use of the results is solely the responsibility of the user engaging in such conduct.
5. Public Space Doctrine & No Expectation of Privacy
PostWatch is designed exclusively for use in public spaces. All content uploaded to PostWatch must depict subjects (persons, vehicles, or scenes) that were observed and photographed in public places where no reasonable expectation of privacy exists under the Fourth Amendment to the United States Constitution and applicable state law. See Katz v. United States, 389 U.S. 347 (1967); United States v. Jones, 565 U.S. 400 (2012).
By uploading content, you represent, warrant, and affirm that:
- The photo was captured by you personally, using your own device.
- The subject matter was plainly visible from a public vantage point (a public road, sidewalk, common area, parking lot, or other publicly accessible location).
- You did not enter private property, restricted areas, or non-public spaces to capture the image.
- No legal, contractual, or regulatory obligation prohibits you from capturing or sharing the image.
- The photo does not depict the interior of any private residence, private property not visible from a public vantage point, or any area where a reasonable expectation of privacy exists.
HOAPOST, LLC has no obligation to verify the origin, legality, or circumstances under which any photo was captured. If you upload content that violates any law or these Terms, you alone bear full legal responsibility. HOAPOST, LLC is not liable for any user's decision to upload content, regardless of the content's nature, origin, or legal status.
6. Safety and Conduct
PostWatch is a passive awareness tool only. Users agree to the following:
- Users shall NOT approach, follow, surveil, confront, or take any direct action against any individual identified or depicted through the Service.
- Users shall only capture photos from their normal, safe vantage point. Users shall never alter their position, path, or route in order to obtain a photo of any individual or vehicle.
- The Service does not replace law enforcement. Users shall contact appropriate local authorities (call 911) regarding any safety concerns or suspected criminal activity.
- Users acknowledge that face detection quality varies based on photo conditions and that attempting to improve results by approaching subjects creates unacceptable safety risks.
HOAPOST, LLC shall not be liable for any injury, harm, loss, or damages of any kind — whether direct, indirect, incidental, consequential, special, exemplary, or punitive — arising from a User's decision to approach, follow, confront, photograph, record, or take any action regarding any individual, vehicle, or property identified or depicted through the Service. By using the Service, you expressly assume all risks associated with your own conduct and irrevocably release HOAPOST, LLC from any and all claims related thereto.
7. Biometric Data
PostWatch processes biometric data (facial recognition embeddings) as described in our Biometric Data Notice. By using the Service, you provide explicit, informed, written consent to this processing. This consent is logged with a timestamp and your IP address and constitutes a binding record under applicable biometric privacy statutes.
8. Data Isolation
Each HOA community's data is completely isolated. Face matching only occurs within your own community's database. No cross-community data sharing occurs.
9. Color Rating System
PostWatch assigns color ratings (Red, Yellow, Green) based on the number of face matches found. These ratings are automated, algorithmic, probabilistic indicators only. They do not constitute accusations, identifications, determinations of guilt, legal findings, or statements of fact by HOAPOST, LLC. No reasonable person should treat a color rating as an identification or an accusation.
10. False Positive Disputes
Users may dispute face matches they believe to be incorrect. Disputed matches are flagged for review and may be excluded from future matching. HOAPOST, LLC makes no guarantee that all false positives will be identified or corrected.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
THE SERVICE IS PROVIDED "AS IS", "AS AVAILABLE", AND "WITH ALL FAULTS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. HOAPOST, LLC MAKES NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
IN NO EVENT SHALL HOAPOST, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES), ARISING OUT OF OR IN CONNECTION WITH:
- Your use of or inability to use the Service;
- Any incorrect, inaccurate, incomplete, or misleading facial recognition results, match determinations, color ratings, vehicle identification results, license plate readings, or any other output of the Service;
- Any false positive, false negative, missed detection, or erroneous identification;
- Any action you take or refrain from taking based on information obtained through the Service;
- Any emotional distress, anxiety, fear, psychological harm, or mental anguish arising from viewing content, receiving alerts, or using the Service in any capacity;
- Any physical injury, property damage, or harm arising from any user's conduct in connection with the Service;
- Any content uploaded by any user, including content that is inaccurate, offensive, defamatory, or otherwise objectionable;
- Any unauthorized access to or alteration of your data or transmissions;
- Any third-party claims arising from your use of the Service or your uploaded content;
- Any interruption, suspension, or termination of the Service.
TO THE EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF HOAPOST, LLC FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO HOAPOST, LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR TEN DOLLARS ($10.00), WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, THE LIMITATIONS ABOVE SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.
12. Section 230 Protection
HOAPOST, LLC operates as an interactive computer service provider within the meaning of Section 230 of the Communications Decency Act (47 U.S.C. § 230). HOAPOST, LLC is not the information content provider of any user-submitted content. All content uploaded to the Service — including photographs, descriptions, tags, vehicle reports, and associated metadata — is created by and is the sole legal responsibility of the user who uploaded it.
No content displayed on PostWatch represents the views, opinions, endorsements, or determinations of HOAPOST, LLC. HOAPOST, LLC shall not be treated as the publisher or speaker of any user-generated content. Any claims arising from user-generated content must be directed to the user who created it.
13. Digital Millennium Copyright Act (DMCA)
13.1 User Responsibility for Uploaded Content
By uploading content to PostWatch, you represent and warrant that you are the original creator of the content (i.e., you personally captured the photograph), that the content does not infringe upon the copyright, trademark, or other intellectual property rights of any third party, and that you have the legal right to assign the content to HOAPOST, LLC under Section 16 of these Terms.
PostWatch is designed for use with original photographs captured by users in public spaces. HOAPOST, LLC does not knowingly host copyrighted material belonging to third parties and has no obligation to screen or verify the copyright status of uploads. If you upload content that you did not personally create, or content that infringes the intellectual property rights of any third party, you alone bear full legal responsibility for that infringement.
13.2 DMCA Takedown Procedure
If you believe that content hosted on PostWatch infringes your copyright, you may submit a takedown notice to our designated DMCA agent. Your notice must include:
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the material that is claimed to be infringing and information sufficient to locate the material;
- Your contact information (name, address, telephone number, email);
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law;
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf;
- Your physical or electronic signature.

13.3 Counter-Notification
If you believe your content was removed in error, you may submit a written counter-notification containing: (a) identification of the removed material; (b) a statement under penalty of perjury that you believe the material was removed by mistake; (c) your name, address, phone number, and consent to jurisdiction in Fulton County, Georgia; and (d) your physical or electronic signature.
13.4 Repeat Infringers
HOAPOST, LLC will terminate the accounts of users who are repeat copyright infringers in accordance with 17 U.S.C. § 512.
14. Voluntary Use, Well-Being & Sole Remedy
PostWatch is an entirely voluntary service. No one is required, compelled, or pressured to use PostWatch.
You may stop using the Service or delete your account at any time, for any reason, through your Account Settings page. If this Service ever causes you stress, anxiety, discomfort, emotional distress, fear, concern, or dissatisfaction of any kind, you are strongly encouraged to immediately stop using the Service and delete your account.
By continuing to use the Service after this point, you have reaffirmed your voluntary consent and acceptance of all risks. Your sole and exclusive remedy for any dissatisfaction with the Service is to cease using it and delete your account. No other remedy — monetary, equitable, or otherwise — shall be available against HOAPOST, LLC for your voluntary decision to continue using the platform despite any discomfort or dissatisfaction.
HOAPOST, LLC provides the Service in good faith as a community awareness tool. HOAPOST, LLC cannot control how you perceive, react to, or are affected by content uploaded by other users. Your emotional and psychological response to voluntarily viewing content is your personal responsibility, not the responsibility of HOAPOST, LLC.
15. Assumption of Risk
By using PostWatch, you knowingly, voluntarily, and irrevocably acknowledge and agree that:
- You voluntarily assume all risks — known and unknown, foreseeable and unforeseeable — associated with using a community safety platform that employs facial recognition technology, automated license plate recognition, and user-generated content.
- You understand that viewing content on PostWatch, including photographs, alerts, match notifications, vehicle reports, and community awareness posts, may cause emotional distress, anxiety, fear, or psychological discomfort, and you expressly and voluntarily assume that risk.
- You understand that facial recognition and OCR technologies are inherently imperfect, probabilistic systems that produce false positives, false negatives, and errors. You assume all risk arising from reliance on any output of these systems.
- HOAPOST, LLC shall not be held liable for any emotional distress, anxiety, fear, psychological harm, physical injury, financial loss, reputational harm, or damage of any kind arising from your use of the Service — whether as an uploader, a viewer, a board member, a law enforcement officer, or in any other capacity.
- You agree to hold harmless, defend, and release HOAPOST, LLC, its officers, directors, members, managers, employees, agents, successors, and assigns from any and all claims, demands, causes of action, damages, losses, costs, expenses (including reasonable attorneys' fees), and liabilities of every nature — whether known or unknown, suspected or unsuspected, disclosed or undisclosed — arising from or in any way related to your use of, exposure to, or participation in the Service.
This assumption of risk and release is intended to be as broad and inclusive as permitted by the laws of the State of Georgia and shall be interpreted in favor of HOAPOST, LLC.
16. Content Ownership & Assignment
By uploading any content to PostWatch, including but not limited to photographs, images, descriptions, tags, and associated metadata, you irrevocably assign and transfer to HOAPOST, LLC all right, title, and interest in and to such content, including all intellectual property rights. This assignment is permanent, worldwide, royalty-free, and survives account deletion, termination, or any discontinuation of your use of the Service.
You represent and warrant that: (a) you are the original creator of the content; (b) you personally captured the photograph using your own device; (c) the content was captured in a public place where no reasonable expectation of privacy exists; (d) you have the legal right and authority to make this assignment; and (e) the content does not infringe upon the rights of any third party. If any of these representations prove false, you agree to indemnify HOAPOST, LLC against all resulting claims, damages, costs, and expenses.
17. Indemnification
You agree to indemnify, defend, and hold harmless HOAPOST, LLC, its officers, directors, members, managers, employees, agents, affiliates, successors, and assigns from and against any and all claims, demands, causes of action, damages, losses, costs, expenses (including reasonable attorneys' fees and court costs), judgments, fines, penalties, and liabilities of every nature arising out of or relating to:
- Your use or misuse of the Service;
- Your violation of these Terms or any applicable law;
- Any content you upload, submit, or transmit through the Service;
- Your violation of any third party's rights, including intellectual property, privacy, or publicity rights;
- Any claim by a third party that your uploaded content infringes their copyright, trademark, or other rights;
- Any action you take in connection with information obtained through the Service;
- Any misrepresentation you make under these Terms;
- Any claim arising from your decision to use the Service despite any discomfort, dissatisfaction, or adverse reaction.
This indemnification obligation shall survive the termination of your account and these Terms.
18. Dispute Resolution & Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
18.1 Informal Resolution
Before initiating any formal dispute resolution proceeding, you agree to first send written notice to HOAPOST, LLC at P.O. Box 53, Fairburn, GA 30213, and attempt to resolve the dispute informally for at least thirty (30) calendar days. Written correspondence is the sole and exclusive method of contact. Most disputes can be resolved without formal proceedings.
18.2 Binding Individual Arbitration
If a dispute cannot be resolved informally within the 30-day period, you and HOAPOST, LLC agree that any and all disputes, claims, or controversies arising out of or relating to these Terms, the Service, your use of the Service, or any content uploaded or accessed through the Service shall be resolved exclusively through final and binding individual arbitration, administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration shall take place in Fulton County, Georgia, or at another mutually agreed location, or via telephone/video if permitted by the arbitrator.
The arbitrator shall have exclusive authority to resolve all disputes, including the scope, enforceability, and arbitrability of this arbitration agreement. The arbitrator's award shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
18.3 Class Action Waiver
YOU AND HOAPOST, LLC AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, MASS ACTION, REPRESENTATIVE ACTION, OR CONSOLIDATED PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative, class, or collective proceeding. If this class action waiver is found to be unenforceable, then the entirety of this arbitration agreement shall be null and void, but the remaining Terms shall remain in full force and effect.
18.4 Exceptions
Notwithstanding the above, either party may: (a) bring an individual action in small claims court if the claim qualifies; (b) seek injunctive or other equitable relief in a court of competent jurisdiction to prevent imminent and irreparable harm.
18.5 30-Day Opt-Out
You may opt out of this arbitration agreement by sending written notice to HOAPOST, LLC at P.O. Box 53, Fairburn, GA 30213 within thirty (30) calendar days of first accepting these Terms. The notice must include your full name, email address associated with your account, and a clear statement that you wish to opt out of the arbitration provision. If you opt out, you and HOAPOST, LLC agree to resolve disputes exclusively in the state and federal courts located in Fulton County, Georgia.
19. Account Termination & Deletion
You may delete your account at any time through your Account Settings page. Upon deletion:
- Your personal information (email, password, profile data) will be permanently erased.
- Biometric embeddings and face crop images associated with your uploads will be deleted.
- Content that has been assigned to HOAPOST, LLC under Section 16 may be retained at HOAPOST, LLC's sole discretion.
- Audit logs recording the deletion event will be retained for legal compliance purposes.
HOAPOST, LLC also reserves the right to suspend or terminate your account at any time, with or without cause, and with or without notice, including but not limited to violation of these Terms, suspected fraudulent activity, abusive conduct, or legal requirements. No refund or compensation shall be owed upon termination.
20. Severability
If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The invalidity of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
21. Waiver
The failure of HOAPOST, LLC to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver of any default shall not constitute a waiver of any subsequent default.
22. Entire Agreement
These Terms, together with the Privacy Policy, Biometric Data Notice, Content Disclaimers, and all other notices and agreements incorporated by reference, constitute the entire agreement between you and HOAPOST, LLC regarding the Service and supersede all prior or contemporaneous agreements, representations, warranties, and understandings.
23. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. Subject to the arbitration provision in Section 18, any disputes not subject to arbitration shall be resolved exclusively in the state and federal courts located in Fulton County, Georgia, and you irrevocably consent to the personal jurisdiction and venue of such courts.
24. Changes to These Terms
HOAPOST, LLC reserves the right to modify these Terms at any time. Material changes will be communicated through the platform or via email. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree with any changes, you must immediately cease use of the Service and delete your account.
