1. Acceptance of Terms
By accessing or using HOA PostWatch ("PostWatch", "the Service"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.
2. Service Description
PostWatch is a community safety platform that uses facial recognition technology to analyze photos uploaded by HOA community members. The Service detects faces in uploaded images, generates biometric embeddings, and cross-references them against existing records within your HOA community.
3. Eligibility
You must be at least 18 years old and a member of a participating HOA community. The Service is not available to residents of Illinois, Texas, or Washington state due to biometric privacy legislation.
4. User Responsibilities
- You will only upload photos you have the legal right to share.
- You will not upload photos for harassment, stalking, or discriminatory purposes.
- You will not attempt to reverse-engineer, manipulate, or deceive the facial recognition system.
- You are limited to 2 photo uploads per day.
5. Biometric Data
PostWatch processes biometric data (facial recognition embeddings) as described in our Biometric Data Notice. By using the Service, you provide explicit written consent to this processing.
6. Data Isolation
Each HOA community's data is completely isolated. Face matching only occurs within your own community's database. No cross-community data sharing occurs.
7. Color Rating System
PostWatch assigns color ratings (Red, Yellow, Green) based on the number of face matches found. These ratings are informational only and do not constitute accusations or legal determinations.
8. False Positive Disputes
Users may dispute face matches they believe to be incorrect. Disputed matches are flagged for review and may be excluded from future matching.
9. Limitation of Liability
PostWatch is provided "as is" without warranties of any kind. HOAPOST, LLC shall not be liable for any damages arising from use of the Service, including but not limited to incorrect face matches, missed detections, or actions taken based on PostWatch data.
10. Section 230 Protection
HOAPOST, LLC is protected under Section 230 of the Communications Decency Act (47 U.S.C. § 230). User-uploaded content is the sole responsibility of the uploading user.
11. Governing Law
These Terms shall be governed by the laws of the State of Georgia. Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts in Fulton County, Georgia.
