Employee Usage Agreement
HOAPOST, LLC — PostWatch Law Enforcement Access Program

PARTIES TO THIS AGREEMENT
This Employee Usage Agreement (“Agreement”) is entered into between:
- HOAPOST, LLC, a Georgia limited liability company, operator of the PostWatch platform (“Company”); and
- The authorized law enforcement officer (“Officer”, “You”).
This Agreement supplements and is incorporated into the Law Enforcement Terms of Service (“LE TOS”). In the event of conflict, the more protective provision in favor of HOAPOST, LLC shall control.
1. PURPOSE. PostWatch provides community-sourced intelligence to law enforcement agencies under a paid departmental subscription. This Agreement governs your individual use of the system as an authorized officer within your department.
2. ACCEPTABLE USE. You agree to use the PostWatch system solely for legitimate, authorized law enforcement purposes. Specifically, you shall:
- Use search results only as investigative leads requiring independent corroboration;
- Not treat search results as confirmed identifications or evidence;
- Comply with all applicable constitutional requirements, including Fourth Amendment protections;
- Not use system data for racial profiling, discrimination, or any prohibited purpose;
- Follow your department’s policies and procedures for use of intelligence tools;
- Not use the system for personal purposes unrelated to official duties.
3. CONFIDENTIALITY. All data, search results, and system functionality accessed through PostWatch are confidential. You shall not:
- Disclose, share, copy, or distribute any data obtained from PostWatch outside of authorized law enforcement channels;
- Screen-capture, photograph, or record system data except as required for official case documentation;
- Discuss system capabilities, results, or data with unauthorized persons, including media, social media, or personal contacts;
- Retain copies of search results beyond the period required for active investigations.
4. AUDIT ACKNOWLEDGMENT. You acknowledge and consent that every search, login, and action you perform within the PostWatch system is permanently logged, including:
- Search parameters (location, radius, plate queries);
- Results returned and results accessed;
- Your IP address, timestamp, and session information;
- Your identity (name, badge number, agency).
These audit records are retained permanently and may be disclosed in response to lawful legal process, internal affairs investigations, or oversight inquiries.
5. PERSONAL ACCOUNTABILITY. You are personally responsible for all activity conducted under your PostWatch credentials. You shall:
- Not share your login credentials with any other person;
- Immediately report any unauthorized access or compromise of your account to your department’s Access Administrator;
- Log out of the system when not actively using it;
- Accept responsibility for any searches or actions taken using your account.
6. LEGAL PROCESS REQUIREMENTS. PostWatch data does not replace or satisfy legal requirements for warrants, subpoenas, or court orders. You acknowledge that:
- System results are probabilistic similarity estimates, not confirmed identifications;
- Independent investigation and corroboration are required before any enforcement action;
- You must obtain appropriate legal process before using any PostWatch data in formal proceedings.
7. PROHIBITED CONDUCT. The following actions constitute grounds for immediate termination of access and may result in civil liability:
- Using PostWatch for stalking, harassment, or intimidation of any individual;
- Conducting searches for personal, non-official purposes;
- Sharing credentials or allowing unauthorized persons to access the system;
- Attempting to circumvent system controls, audit logging, or access restrictions;
- Using search results to confront, detain, or take adverse action against individuals without independent basis.
8. DEPARTMENT POLICY COMPLIANCE. Your use of PostWatch must comply with your department’s policies regarding use of intelligence tools, facial recognition technology, and surveillance systems. If any provision of this Agreement conflicts with your department’s policies, the more restrictive provision shall control.
9. INDEMNIFICATION. You agree to indemnify, defend, and hold harmless HOAPOST, LLC from any claims, damages, or expenses arising from your misuse of the PostWatch system, breach of this Agreement, or violation of applicable law in connection with your use of system data.
10. TERMINATION. Your access to PostWatch may be terminated at any time by your department’s Access Administrator, by HOAPOST, LLC, or by the PostWatch superadmin. Upon termination, all obligations under this Agreement regarding confidentiality, audit acknowledgment, and indemnification survive.
11. GOVERNING LAW & VENUE. This Agreement shall be governed by the laws of the State of Georgia. Any dispute arising under this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in Fulton County, Georgia.
12. ACKNOWLEDGMENT. By signing below, you acknowledge that you have read this Agreement in its entirety, understand your obligations, and voluntarily agree to be bound by its terms as a condition of accessing the PostWatch law enforcement search system.
