Legal basis. Under Section 230 of the federal Communications Decency Act (47 U.S.C. § 230(c)(1)), a provider of an interactive computer service “shall not be treated as the publisher or speaker” of information provided by its users — the reviewers alone are responsible for what they post. Truthful statements are protected as a complete defense under Georgia law (O.C.G.A. § 51-5-6) and by the Georgia Constitution’s guarantee that “every person may speak, write, and publish sentiments on all subjects” (Ga. Const. Art. I, Sec. I, Par. V).
